Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the websites, pickup request flows, communications, and related services offered by Richmond Consignment (“Richmond Consignment,” “we,” “us,” or “our”). By using our website, submitting a pickup request, or using consignor services, you agree to these Terms. If you do not agree, do not use our services.
If you are entering into consignment as a consignor, additional written or electronic terms (a consignor agreement, intake form, or onboarding materials) may apply. If there is a conflict between those materials and these Terms on a specific commercial point (for example a customized fee schedule), the consignor-specific agreement controls for that point. Otherwise, these Terms apply.
Eligibility and authority
You represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are submitting items for consignment, you represent that you own the items or have legal authority to consign them, and that consigning the items does not violate any agreement, court order, lease, lien, or third-party rights.
Description of services
Richmond Consignment provides resale-related services that may include home pickup (in Richmond, VA and nearby communities we serve), intake and processing of inventory, pricing and photography, listing on third-party marketplaces, buyer communication, shipping and fulfillment support as applicable, reconciliation of marketplace activity, and payouts to consignors. Exact services depend on what we agree to for your items and may change over time as platforms and operations evolve.
Pickup requests; no guarantee of acceptance
Submitting a pickup request does not guarantee we will accept your items, schedule a pickup, or enter into a consignor relationship. We may decline items that are unsuitable, unsafe, illegal to sell, out of service area, or inconsistent with our operational capacity. Information you submit through forms must be accurate and not misleading.
Access to your premises
If we perform a pickup at your location, you agree to provide safe, lawful access at the scheduled time (or as otherwise agreed), and to disclose hazards (for example pets, stairs, narrow entries) that could affect the pickup. You are responsible for ensuring that any items provided for pickup are yours to transfer and are free of undisclosed claims.
Inventory custody, title, and risk
Once items are accepted into consignment, custody and operational handling are governed by your consignor agreement and our documented processes. Generally, we need practical control of items to photograph, store, list, and ship them. Risk of loss or damage while items are in our custody is addressed in your consignor agreement; these Terms do not replace item-specific liability allocations or insurance discussions that belong in that agreement.
You represent that items are authentic as described (where authenticity matters), are not stolen, and comply with applicable laws and marketplace policies. You are responsible for claims arising from inaccurate descriptions, undisclosed defects, or unlawful goods.
Fees; marketplace economics
Unless we agree otherwise in writing, our standard consignment fee is 37% of the sale price, calculated net of marketplace and platform fees (that is, after platform fees are deducted from the sale proceeds used for the split). Shipping allocations, refunds, chargebacks, holds, promotions, multi-item orders, and other edge cases can change the math; those details are handled in your consignor agreement and operational policies.
Third-party marketplaces impose their own fees, rules, and payout timing. We are not responsible for platform outages, policy changes, account restrictions, or buyer disputes beyond what we reasonably control.
Payouts
We aim to pay consignors on a weekly cadence for eligible sold-and-settled items, using payout methods we support (for example electronic payouts where you provide valid payout instructions). Payouts may be withheld or adjusted where necessary to resolve returns, chargebacks, fee corrections, or suspected fraud. You are responsible for keeping payout details accurate in the portal (where available) or through communications with our team.
Prohibited items and conduct
You may not use our services to sell illegal goods, regulated items without required compliance, counterfeit goods, items obtained fraudulently, or items that violate marketplace policies. You may not harass our staff, misuse our systems, attempt unauthorized access, scrape our site in violation of law, or interfere with other users’ use of the service.
Accounts and security
If you have a consignor portal account, you are responsible for safeguarding your credentials and for activity under your account unless caused by our negligence. Notify us promptly if you suspect unauthorized access.
Intellectual property
We retain rights in our branding, website content, processes, and materials we create (including photographs and listing copy we produce as part of services), subject to your consignor agreement. You grant us the rights reasonably necessary to list, market, sell, and fulfill sales for consigned items, including using images and descriptions on marketplaces and in internal tools.
Disclaimers
Except where prohibited by law, our website and services are provided “as is” and “as available.” We disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted.
Limitation of liability
To the fullest extent permitted by law, Richmond Consignment and its owners, contractors, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost goodwill, or lost data, arising out of or related to these Terms or the services—even if advised of the possibility.
To the fullest extent permitted by law, our aggregate liability for claims arising out of or related to these Terms or the services will not exceed the greater of (a) the fees you paid to us in the twelve (12) months before the claim or (b) one hundred U.S. dollars (US $100), except that this limitation does not apply to liability that cannot be limited under applicable law (for example certain intentional misconduct or personal injury caused by gross negligence, where applicable).
Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Richmond Consignment and its personnel from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your items, your representations, your violation of these Terms, or your violation of third-party rights or laws.
Governing law; venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Subject to applicable law, you agree that exclusive jurisdiction and venue for disputes will be in state or federal courts located in Richmond, Virginia, and you waive any objection to jurisdiction and venue in those courts.
Changes; termination
We may modify these Terms by posting an updated version on our website and updating the effective date. Material changes may include additional notice where appropriate. We may suspend or terminate access to the website or portal for violations of these Terms or operational risk. Consignor wind-down (returns, final payouts, and records) is governed by your consignor agreement and applicable law.
Miscellaneous
These Terms constitute the entire agreement between you and us regarding the subject matter here (except for any separate consignor agreement). If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
